Court Rulings A retention policy must be deemed "reasonable" when viewed in light of the particular industry. If the retention policy in place allows for the destruction of electronic data sooner than that which is normally deemed standard within a certain business practice, then the producing party is precluded from "hiding behind" the insufficient policy as a rationale for its inability to produce requested electronic data. |
